Grow Fergus Falls seeking a delay for April 22 special vote - admin.cody - 03-07-2010 10:50 PM

“Grow Fergus Falls, Inc.” is seeking an injunction that would delay or stop the upcoming April 22<sup>nd</sup> special vote on a proposed spending ordinance.

The people behind Grow Fergus Falls include Robert Block, Scott Wagnald, Kelsey Felstul, Chad Felstul, and Erik Ahlgren, with attorneys Morrie Kershner and Steve Rufer representing them.

On the court hearing on March 5<sup>th</sup>, Kershner  told Judge Mark Hansen that the proposed spending ordinance, brought together by the Fergus Votes Committee, is unworkable and it would halt business growth within the city. Grow Fergus Falls also believes that the Fergus Votes ordinance is a “minefield of disasters”.

The attorneys representing Grow Fergus Falls are passionate about the success of the injunction and are providing their services for free.

Rolf Nycklemoe, an attorney for the City of Fergus Falls, says they’re still preparing for the April 22<sup>nd</sup> vote, and will continue to do so unless a judge grants the injunction.  The next court hearing could come as early as this week.

this looks like who ever runs out of money first loses. i think that the ff grow group is afraid that this will pass and there won't be a ice palace.

i see that four people want a curling rink in there also, for some unkown reason that they think that this would be actually used and bring mega bucks to town.

While against how this was pushed through I realize it is likely to happen. Anybody that does more to make this a multi-use facility is aces in my book. While curling is still an ice activity and I would like to see things like climbing walls, indoor track, skate park, etc included in a facility like this at least it is a start.

i having been hearing that this law is called applicable. even thou i dont understand it i know it is considered a nusicene law by lawyers. meaning even if it passed. the city council could in theroy bypass it or take it to court to temporarly overide it. so my question becomes why even spend 13,000 on somthing that would have no effect?

what i don't understand about the city is, one day they talk about not having money coming in but the next is let's spend like crazy.

It does seem to be a somewhat contradictory position--can't afford fireworks or lifeguards at Pebble Lake but we can somehow pay for these big extra projects that seem to benefit a relatively small percentage of the local population.
What's up with that?

Well fireworks, while really neat, actually are farther down on my list of necessary then the ice arena. Pardon the expression but the fireworks are just a "flash in the pan". However I put lifeguards above an ice arena as while neither will pay for themselves at least the average kid can go swimming with out a few hundred dollars worth of equipment.

An added benefit is that not having fireworks irritates Lincoln and anything that does that gets my vote. Smile
